Can a Neighbour Stop Your Extension? A Guide to Party Wall Notices

One of the most common concerns we hear from homeowners planning an extension is:

“What if my neighbour tries to stop the build?”

The good news is that they usually can’t, especially if you follow the correct process.

However, if your plans affect a shared boundary, party wall, or involve excavation near a neighbouring property, you will likely need to serve a Party Wall Notice, and in some cases obtain a Party Wall Award.

This guide explains what Party Wall Notices are, when they are required, and how to manage the process smoothly.

What Is a Party Wall Notice?

The Party Wall etc. Act 1996 is a UK law designed to protect both you and your neighbours when building work affects shared walls, boundaries, or nearby structures.

You will usually need to serve a Party Wall Notice if you are:

  • Building on or near a boundary line
  • Excavating within 3 metres (or sometimes 6 metres) of a neighbouring structure
  • Cutting into or altering a shared wall, such as with a loft conversion or side extension

This process is not about asking permission to build. It is about agreeing how the work will be carried out to avoid disputes or damage.

Party Wall Notice vs Party Wall Award

Party Wall Notice

This is a formal notification sent to your neighbour outlining the proposed work.

Your neighbour can either:

  • Consent, allowing work to begin after 14 days
  • Dissent, which means surveyors will need to be involved

Party Wall Award

If surveyors are required, they will produce a Party Wall Award. This is a legal document that sets out:

  • How the work will be carried out
  • What protections are in place
  • Who is responsible for costs
  • What happens if damage occurs

Can a Neighbour Stop Your Extension?

No. A neighbour cannot stop your extension simply by objecting to a Party Wall Notice.

As long as you have:

  • Planning permission (if required)
  • Building Control approval
  • Served the correct Party Wall Notice

Your project is legally protected.

If your neighbour dissents, the process continues with surveyors agreeing an Award. This may add time and cost, but it should not prevent the project from going ahead.

What If Your Neighbour Doesn’t Own Their Property?

If your neighbour rents their home, the Party Wall Notice must be served to the legal owner of the property.

Private tenants

You must serve the Notice to the landlord or freeholder, not the tenant. It is still a good idea to inform the tenant to keep things amicable.

Council or housing association properties

The council or housing association is the legal owner and must receive the Notice.

These organisations may require additional steps, which can increase timeframes, so it is best to start early.
